Federal judge says inmate attacked by other prisoners cannot sue corrections officers

Emanuel Pittman failed to show corrections officials knew there was not just a risk of an attack, but a ‘substantial’ risk

An incarcerated man, allegedly attacked by other prisoners because of his status as a sex offender, cannot sue corrections officials for failing to protect him, a federal judge ruled last month.

Even though Emanuel Pittman reportedly told multiple prison officials that other inmates were threatening his life, U.S. Magistrate Judge Kristen L. Mix explained it was not enough that the defendants knew there was “merely” a risk to Pittman. Instead, there had to be a “substantial” risk of harm.

“Plaintiff cannot rely solely on the allegation that they should have perceived a substantial risk from these conversations,” she wrote in an April 11 order.

 
According to his lawsuit, when Pittman arrived at Limon Correctional Facility in August 2021, he told a prison employee of rumors that sex offenders “got beat up” or were extorted at the facility. Case manager Jeremy Kahn was present for that conversation, and Pittman subsequently talked with Kahn about the purported threats to his life.

“His reply was you & your kind just want something to be mad about,” wrote Pittman, who represented himself in the lawsuit.

The true predators are on the wrong side of those prison bars!!!!

Just another example of how the Government protects itself from earned liability at the expense of those that it is there to protect. I myself lost the vision in one eye because of a detached retina. The initial injury was as a result of transport officers, & the resulting blindness from lack of treatment while at Lompoc FCI. Both eyes had detached retinas & one required immediate surgery, the other eye was supposed to be monitored for worsening condition, but I was never taken back for any follow ups. I was told that the Federal Court, as in the above situation had set the bar at what they referred to “willful neglect” they had to know that it was cause blindness not to take me back . Oh well at least I am no longer locked up.

Pretty sad when criminals can sue you, but you can’t sue them.

In California the CDCC got rid of Sensitive Needs Yards, So now everyone is GP there is no protective custody, The government made up some BS about why they were no longer needed BUT we all know this was strategically done to make life in prison harder for people convinced of crimes against children.
They didn’t like the fact that offenders were surviving long sentences comfortably and making it home safe and sound.
So now CO’s have the power to put anyone they want into your cell.
It’s crazy just knowing, A failure to register change could easily cost you your life here in California

Damn right I’m mad that registrants are harmed/murdered at the hands of inmates due to their government sponsored bs label, while prison officials and guards allow it to happen. Prisons should be for punishment along with rehabilitation for when they are released to be law abiding citizens, instead prisons turn people into better criminals.

So in Colorado, a sex crime conviction is a death sentence. Probably best to never commit a sex crime anywhere […]
